Supreme Court to Determine American Parents' Rights to Retrieve Children Wrongfully Abducted or Retained Abroad

International Family Law Attorney Michael Manely appeals to U.S. Supreme Court to determine all American parents' rights to obtain a court order for the return of children abducted or wrongfully retained abroad. Manely's client, U.S. Army Sergeant 1st Class Jeff Chafin, who served his country in Iraq and Afghanistan, turns now to his country to protect his parental rights.

On December 5, 2012, The Supreme Court of the United States will hear oral argument in Chafin v. Chafin, No. 11- 1347, to determine if Federal Courts may order the return of a child abducted or wrongfully retained abroad. The Eleventh Circuit Court of Appeals, Atlanta, GA, held in Bekier v. Bekier, 248 F. 3d 1051 (11th Cir. 2001) that Federal Courts lack jurisdiction to issue such an order once the child is taken from U.S. soil.

On February 6, 2012 the same court denied Sergeant 1st Class Chafin?s request to review a Federal District Court decision allowing his four year old daughter to be taken by his estranged wife to Scotland. The Eleventh Circuit Court held that even if the District Court had erred, they were powerless to issue a return order because the child was no longer in The U.S.

Other Federal Circuit Courts of Appeal disagree, citing the provisions set forth by The Hague Convention on the Civil Aspects of International Child Abduction and The Federal International Child Abduction and Retention Act. The Supreme Court of The United States granted Chafin?s Petition for Writ of Certiorari to resolve the split. Chafin?s international family law attorney, Michael E. Manely, points out that rendering U.S. Courts powerless to order the return of American children would encourage abduction and retention abroad which the Hague Convention on Child Abduction is intended to prevent.

Chafin's daughter was turned over to her Scottish mother by a lower Federal District Court. Attorney Manely explains that the lower court denied his request for a stay and within two hours Chafin's daughter was taken out of the country by her mother, a woman she hadn?t seen in a year. Chafin says even though he served in Iraq and Afghanistan, he has never feared anything more than losing the opportunity to parent his daughter. He is looking to the U.S. Courts to protect his parental rights.

Did dinosaurs roam Grand Canyon?

The awe-inspiring Grand Canyon was probably carved about 70 million years ago, much earlier than thought, a provocative new study suggests ? so early that dinosaurs might have roamed near this natural wonder.

Using a new dating tool, a team of scientists came up with a different age for the gorge's western section, challenging conventional wisdom that much of the canyon was scoured by the mighty Colorado River in the last 5 million to 6 million years.

Not everyone is convinced with the latest viewpoint published online Thursday in the journal Science. Critics contend the study ignores a mountain of evidence pointing to a geologically young landscape and they have doubts about the technique used to date it.

The notion that the Grand Canyon existed during the dinosaur era is "ludicrous," said geologist Karl Karlstrom of the University of New Mexico in Albuquerque.

How the Grand Canyon became grand ? with its vertical cliffs and flat plateaus ? has been debated since John Wesley Powell navigated the whitewater rapids and scouted the sheer walls during his famous 1869 expedition.

Some 5 million tourists flock to Arizona each year to marvel at the 277-mile-long chasm, which plunges a mile deep in some places. It's a geologic layer cake with the most recent rock formations near the rim stacked on top of older rocks that date back 2 billion years.

Though the exposed rocks are ancient, most scientists believe the Grand Canyon itself was forged in the recent geologic past, created when tectonic forces uplifted the land that the Colorado River later carved through.

The new work by researchers at the University of Colorado Boulder and California Institute of Technology argued that canyon-cutting occurred long before that. They focused on the western end of the Grand Canyon occupied today by the Hualapai Reservation, which owns the Skywalk attraction, a horseshoe-shaped glass bridge that extends from the canyon's edge.

To come up with the age, the team crushed rocks collected from the bottom of the canyon to analyze a rare type of mineral called apatite. The mineral contains traces of radioactive elements that release helium during decay, allowing researchers to calculate the passage of time since the canyon eroded.

Their interpretation: The western Grand Canyon is 70 million years old and was likely shaped by an ancient river that coursed in the opposite direction of the west-flowing Colorado.

Lead researcher Rebecca Flowers of the University of Colorado Boulder realizes not everyone will accept this alternative view, which minimizes the role of the Colorado River.

"Arguments will continue over the age of Grand Canyon, and I hope our study will stimulate more work to decipher the mysteries," Flowers said in an email.

It's not the first time that Flowers has dug up evidence for an older Grand Canyon. In 2008, she authored a study that suggested part of the eastern Grand Canyon, where most tourists go, formed 55 million years ago. Another study published that same year by a different group of researchers put the age of the western section at 17 million years old.

If the Grand Canyon truly existed before dinosaurs became extinct, it would have looked vastly different because the climate back then was more tropical. Dinosaurs that patrolled the American West then included smaller tyrannosaurs, horned and dome-headed dinosaurs and duckbills.

If they peered over the rim, it would not look like "the starkly beautiful desert of today, but an environment with more lush vegetation," said University of Maryland paleontologist Thomas Holtz.

Many scientists find it hard to imagine an ancient Grand Canyon since the oldest gravel and sediment that washed downstream date to about 6 million years ago and there are no signs of older deposits. And while they welcome advanced dating methods to decipher the canyon's age, Karlstrom of the University of New Mexico does not think the latest effort is very accurate.

Karlstrom said it also defies logic that a fully formed canyon would sit unchanged for tens of millions of years without undergoing further erosion.

Geologist Richard Young of the State University of New York at Geneseo said his own work suggests there was a cliff in the place of the ancient Grand Canyon.

Flowers "wants to have a canyon there. I want to have a cliff there. Obviously, one of us can't be right," he said.

Whatever the age, there may be a middle ground, said Utah State University geologist Joel Pederson.

Researchers have long known about older canyons in the region cut by rivers that flow in a different direction than the Colorado River. It's possible that a good portion of the Grand Canyon was chiseled long ago by these smaller rivers and then the Colorado came along and finished the job, he said.

Worker laid off at New Mexico peanut butter plant

PORTALES, N.M. (AP) ? A peanut butter plant along the New Mexico-Texas border has laid off a third of its 150 workers after federal authorities shuttered the plant.

A salmonella outbreak traced to the peanut butter has sickened 41 people in 20 states.

Millions of pounds of the regions prized sweet Valencia peanuts sit in barns at the Sunland peanut butter plant.

Farmers are worried about getting paid. And residents wonder what toll the shutdown will have on the region's economy.

The tension boiled over on Monday, when the Food and Drug Administration suspended Sunland's registration to operate because of repeated safety violations. It came just as the plant was set to resume shelling the bumper crop.

Drug may offer new approach to treating insomnia

ScienceDaily (Nov. 28, 2012) ? A new drug may bring help for people with insomnia, according to a study published in the November 28, 2012, online issue of Neurology?, the medical journal of the American Academy of Neurology.

The drug, suvorexant, blocks the chemical messengers in the brain called orexins, which regulate wakefulness. Other drugs for insomnia affect different brain receptors.

Taking the drug suvorexant increased the amount of time people spent asleep during the night, according to the study. The study involved 254 people ages 18 to 64 who were in good physical and mental health but had insomnia that was not due to another medical condition.

The participants took either the drug or a placebo for four weeks, then switched to the other treatment for another four weeks. The participants spent the night in a sleep laboratory with their sleep monitored on the first night with each treatment and then again in the fourth week of each treatment.

While taking the drug, participants' "sleep efficiency," which reflects the total amount of time they slept during a fixed, eight hour time in bed, improved by 5 to 13 percent compared to those taking the placebo. They also experienced 21 to 37 fewer minutes awake during the night after they had fallen asleep than those who took the placebo. "This study provides evidence that suvorexant may offer a successful alternative strategy for treating insomnia," said study author W. Joseph Herring, MD, PhD, of North Wales, Penn., Executive Director of Clinical Research with Merck, the maker of suvorexant, and a member of the American Academy of Neurology. "Suvorexant was generally well-tolerated, and there were no serious side effects."

Herring said larger, longer studies have recently been conducted on suvorexant, along with studies to determine whether the drug could be safe and effective for elderly people, who make up a large percentage of those suffering from insomnia.

Merck has submitted a new drug application for the treatment with the U. S. Food and Drug Administration.

The study was funded by Merck Research Laboratories.

In my last blog, I talked about old-school allowance, both the pitfalls my husband and I saw with our system for our three kids and the solution we eventually worked out. (Thank goodness for spreadsheets!)

But there?s a new twist on allowance that has emerged over the past few years: techno money management. Instead of handing kids a few dollars each week, parents?and kids!?can simply visit one of many websites, just as adults manage their own banking online.

Having never used an allowance website with my kids, I was surprised to find there are more than a dozen options. (I recently went on National Public Radio?s Marketplace to discuss this topic?listen here!)

My big question: Do allowance websites make kids more?or less?money savvy? Below are the pros and cons.

Free Sites: Shopping Vs. Saving

At first glance, free sites like Tykoon may seem like the best options. But these sites often make money by encouraging kids to spend their allowance in their online stores, which are full of toys, DVDs, iPads, and other enticing items via a partnership with Amazon.

Kids can also donate money to a charity or reach a savings goal, but I imagine the temptation of those toys would be tough to resist. Each visit to the website is an opportunity to shop.

That said, I?m no Grinch! Kids should certainly use part of their allowance to buy something they want and learn about making choices and comparing prices.

But allowance is also a great tool to teach the value of saving. For parents who use these sites, I encourage you to set up your child?s account so that a high percentage (at least 25%) of allowance goes toward saving.

Paid Sites: Are They Worth the Fee?

On the other hand, sites like FamZoo and Three Jars that charge families an annual subscription rather than run an Amazon-sponsored store may not be worth the fee, which ranges from $30 to $72 per year.

For that fee, all you really get is a glorified ?gold star chart? that tracks allowance, since for all the sites?paid or free?no actual money is being transferred online. When kids want to cash out, the money still comes directly from you, either by giving your kid cash (when using a paid site) or using your credit card to purchase an item in an Amazon-sponsored store (when using a free site).

One good deal: Three Jars occasionally offers a free membership for life, no strings attached. You can take advantage if you sign up by December 31, 2012.

Don?t Let Cash-Free Mean Conversation-Free

Although we tend to be a cash-using family, I know that a lot of parents rely on plastic and rarely have cash around, which makes doling out dollar bills each week or each month a bit tricky. A recent survey by public opinion polling company Rasmussen Reports found that 4 out of 10 adults easily make it through the week without any cash at all.

To add to that issue, 8 out of 10 parents say they?re equipped to have the money talk, but a third say they?re just not following through, according to a survey by T. Rowe Price.

My main concern: Allowance sites can be an impediment to money talks, rather than a way to facilitate those conversations. Why talk about saving for a goal or the family budget when you can just automate your kid?s weekly allowance?

Automating saving and bill paying are good habits for adults. But do we really want to automate our kids? financial education?

10 Essential Social Media Tips for Local Online Marketing

Recently I was helping some friends get their social media accounts set up for their new coffee shop. A local business like a coffee shop is not going to get a lot of value from many techniques used by content and inbound marketers. Their new coffee shop, Caf? Love in Olympia, Washington, is not going to generate customers with a blog. (Well, they could generate customers with a blog but it would need to be special and that would not be the first thing I would suggest.) Caf? Love will benefit from a social media presence and getting found on internet searches. As I was working with Vanessa and Marty I thought it would be good to have a quick list of the accounts that should be set up.

This list would be great for any business but especially for location based businesses that depend on local traffic and people actually coming into their business. This could include any type of restaurant, or business in the food and beverage industry; services such as barbers and beauty solons; automobile services, pet services, grooming and supplies; dancing schools and music stores; any type of brick and mortar stores; private businesses; franchise businesses; government offices and services; charity and non-profit services; and medical and health services. The exact mix of accounts and what works best for you and your customers may vary a bit but this is where I would start. Remember to experiment, see what works best and to try new things.

1. Facebook

With Facebook practically ubiquitous in North America it would be silly to ignore this. Remember to set up a personal account first then set up a business page. Once that is done you can invite others to help you administer the page. A few things to be sure to do:

  • Pick the correct category for your business
  • Set up your address so you show up on the map location
  • Put in your contact information
  • Learn about setting up Check-in Deals
  • Create and promote events
  • Adds can be targeted to your locations and to your customer profile
  • Update with photos of your space, products and events

2. Twitter

You can set up a Twitter account for your business and use it to promote your business, sales and events and connect with your customers and fans. Twitter may not be for every local business but there are a number of things you can do to make it more effective:

  • Follow and promote other local businesses
  • In Twitter Search use the Advanced Search to find people and business in ?places? near you
  • Act like a person people would want to do business with, not an advertising broadcaster
  • Tweet about specials and coupons featured on your other accounts like Facebook and Foursqure
  • Send photos of events, regular customers and products

3. Foursquare

It is easy and free to set up Foursqure?for business?and Foursqure keeps track of your fans and check-ins for you.

  • Make sure the address is correct so you show up on maps and searches
  • Reward the mayor and frequent customers
  • Set up check-in specials
  • Post new images and photos
  • Connect to your other social media accounts
  • Foursqure Badges are connected to certain activities and businesses and are half the fun. What badges can your customers earn and how you can you make it fun?

4. Myspace

The obituaries for myspace have been written but I wouldn?t nail the coffin shut yet because it is reinventing itself as the social media location for bands and entertainers. If your location business features live bands and entertainers then set up a Myspace account and connect and promote the bands, singers, comedians and dancers who will perform at your business.

5. Google+ and Google Locations

I?ve written that Google Places is now Google+ Local and published an eBook on the importance of Claiming Your Google Places. Google is such a big player now that it is important for any location based business to set up a Google+ Business Page and to claim their Google Places. Not only will this help you get found on Google searches you will show up on searches for Google Maps. This is essential especially when people do searches on their smart phones and that is exactly where you want to show up, when people are out looking for your services or product. A few things you should be sure to do:

  • Put in your contact information
  • List your hours of operation
  • Put a link to your menu or web site
  • Follow statistics about views for your listing
  • Use offers and coupons
  • Share updates about events, specials and more

6. Google Express Ads

In a recent blog I wrote that Google AdWords Express was a great solution for small business marketing. If you have thought about Pay-Per-Click ads but were intimidated by setting up Google AdWords or you do not have a website then this may be a great solution. This is specifically designed for small, location based businesses and is aimed at walk-in customers. It is worth checking out. If you need help we have a free Google Adwords consultation.

7. Yelp

Yelp is the other big location search engine and it is defiantly worth setting up an account and putting in your business? location and information. Yelp is famous for its reviews and this is something you want to be aware of and to follow.

8. Punchcard

I do not often push paid solutions but punchard is one that I have recently looked into that I like. It is a loyalty punch card system optimized for mobile applications. Your customers take a photo of their receipt and can redeem coupons and specials from you along the lines of buy 10 lattes and get the 11th latte free. As the business you get an amazing amount of information from your customers who check in so that you can tailor specials, coupons and promotions directly to the customer. For example set up specials for the customer who loves muffins, only comes in on Friday or never seems to spend more the $5. It is worth a look if rewarding loyal customers is important to you.?

Another paid solution that I do not have a lot of experience with but I know others who swear by it is Groupon?and similar coupon services.?

9. Local Listings

There are a number of other places your business can be listed depending upon your location. Check out the local Chamber of Commerce, local newspapers or your city?s official website. There is often a place to list local businesses. Depending on what is going on locally there may be a website devoted to local businesses or certain types of business such as restaurants or nightclubs. Search for businesses similar to yours and see where they are listed. Most of these sites will at least have a free listing and many will have enhanced services for a fee. What is important to you will determine what will be the best option.

10. Keep Track and Reward

Remember to keep track of what is bringing customers in. With Foursqure and Facebook you will be able to see who checks in but ask your customers what they are doing and how they found out about you. Run different specials and coupons on different sites and see what generates business. Remember to reward your customers who connect with you on social media and promote your business. If a customer is telling others about you, that is free advertising so thank them from time to time.

A senior member of Bite Communications' finance team is suspected of embezzling nearly $3 million from the company, its corporate parent disclosed today in a delayed annual report.

San Francisco-based Bite's clients include Microsoft, Nokia, Sony and Mozilla

The executive was not named.

?I feel like we had a relative of Bernie Madoff working for us without us knowing,? CEO Tim Dyson told PRWeek. ?We expect the case will take many months to work its way through the legal systems due in part to its complexity.?

Next Fifteen, the British PR agency holding company, disclosed in its annual report that the fraud was "an act of personal embezzlement by a long-serving employee in a trusted position heading up the finance team in the Bite office in San Francisco. This entailed a cheque fraud over a number of years, involving forging signatures and producing forged documentation. The weaknesses of controls that allowed this to happen were a lack of segregation of duties, management override of controls and inadequate review."

The FBI and SFPD are investigating. The Guardian previously noted:

Next Fifteen said that it has informed the FBI and is working with BDO, its external auditors, as well as hiring investigations firm Kroll to carry out a full forensic investigation of all the activities within this part of the business.

There has been a recent management shuffle at the company, but none of the executives named publicly to new positions are believed to be involved, according to PRWeek. Bite also lost its HP account, according to O'Dwyer's.

Here are all the details known publicly about the fraud, condensed and compiled from Next Fifteen's annual report. (Readers: if you know something about what happened at Bite, we'd love to hear from you.)

On 31 October 2012 we informed shareholders that, in the latter stages of finalising the audit, a fraud was discovered in the San Francisco office of Bite Communications. This has now been thoroughly investigated with the conclusion that this was an act of personal embezzlement by a long-standing member of the finance team in a trusted position. The required accounting adjustment has been to write off as an exceptional item $2.8m (?1.8m) (see note 4) relating to unrecoverable assets and unrecorded liabilities, reflecting cash stolen from the business. The fraud continued into the early part of the current financial year, which will require a further write-off of $0.2m (?0.1m). This crime is now being investigated by the FBI and the SFPD. All steps will be taken to recoup lost assets but it is too soon to estimate the likely scale of any recovery.

The Board is undertaking a comprehensive review of the internal financial controls environment, the details of which you can find in the Financial Review. Meanwhile, as indicated in the statement of 31 October, this regrettable event will not impact the operational performance of the Group or affect its ability to make the investments it has planned for the coming year.

As described in the Chairman?s Statement, the Group has suffered from an act of personal embezzlement by a long-serving employee in a trusted position heading up the finance team in the Bite office in San Francisco. This entailed a cheque fraud over a number of years, involving forging signatures and producing forged documentation. The weaknesses of controls that allowed this to happen were a lack of segregation of duties, management override of controls and inadequate review. Prior to 1 August 2010 the amounts were small and were expensed through the income statement, amounting to an identified total of $300k (?190k). As the amounts increased they were accumulated in the balance sheet, spread over two statutory entities. The total amount of cash taken is around $3m (?1.9m). We have identified that $200k (?127k) was taken after 31 July 2012 and will therefore be expensed in the current year. For the remaining $2.8m (?1.8m), the ongoing investigation has so far identified that around $1.4m (?0.9m) cash was extracted in 2012, and $1.4m (?0.9m) prior to 2012 ($0.7m (?0.4m) in 2011 and $0.7m (?0.4m) prior to 2011).

As at 31 July 2012, a total of $2.5m (?1.6m) was held on the balance sheet and represented by fictitious assets. Of that $2.5m (?1.6m), an amount of $1.1m (?0.7m) had existed at 31 July 2011. The Board have concluded that allocating the impact of the write off across each respective prior year would not make a material difference to an understanding of the accounts.

A further $0.3m (?190k) was identified relating to unrecorded tax liabilities and associated penalties and interest which have now been accrued. The write off and recognition of liabilities has resulted in a total charge associated with the fraud of $2.8m (?1.8m) being recognised in the 2012 income statement (see note 4).

In response to this fraud, the Board is undertaking a comprehensive review of the internal financial controls environment, including cash management involving both payments and receipts. A decision has been taken to create a dedicated Internal Audit function, with resources to be recruited in the US and UK.

Falcons overcome mistakes to beat Buccaneers 24-23

TAMPA, Fla. (AP) ? Atlanta coach Mike Smith spoke highly of the Falcons' defense. Without its solid performance, Matt Ryan may not have had an opportunity to lead his latest game-winning drive.

The Falcons (10-1) held off Tampa Bay 24-23 Sunday, overcoming two turnovers by their star quarterback in part because the Buccaneers settled for a pair of field goals rather than touchdowns after Ryan threw a second-quarter interception and lost a fumble on a fourth-quarter sack.

"I thought our defense did an outstanding job again. They were put in some tough situations after turnovers," Smith said, adding that limiting Bucs rookie Doug Martin to 50 yards rushing on 21 carries was a key to the game as well.

"We knew it was going to be one of our 'musts,' and I thought we did a nice job," Smith added. "I thought we played the run extremely well, controlled the line of scrimmage. That is an outstanding running back."

Ryan completed his first 10 passes and finished 26 of 32 for 353 yards and one touchdown, an 80-yarder to Julio Jones, who had nine receptions for 147 yards despite playing on a sore right ankle that limited him in practice.

Atlanta got a lift from the return of linebacker Sean Weatherspoon, who was back after missing three games with an ankle injury.

Josh Freeman threw for 256 yards for Tampa Bay, however he was sacked twice and failed to throw a touchdown pass for the first time in 14 games. Martin scored both of his team's TDs on 1-yard runs and Connor Barth kicked three field goals.

"It's hard to win games by threes," coach Greg Schiano said. "Sevens add up considerably quicker."

The Falcons (10-1) kept pace with the Houston Texans for the NFL's best record and ended a four-game winning streak by the up-and-coming Bucs (6-5).

"They are playing with a lot of confidence," said Ryan, who has won seven of his past eight starts against the Bucs. "It's always been a tough place for us to come play. They play with great effort, and I think they have a good football team."

Ryan teamed with Jones on his long TD midway through the third quarter, but the Falcons found themselves trailing 23-17 after the Bucs marched to Martin's second TD, then used a sack-fumble to set up a field goal that left Atlanta needing another fourth-quarter comeback to win.

Ryan obliged by a leading a six-play, 64-yard march that Michael Turner finished with a 3-yard TD run that put the NFC South leaders ahead for good with 7:55 remaining.

Barth missed a 56-yard goal for Tampa Bay in the closing minutes, and the winning streak that's helped the Bucs climb back into playoff contention following a 1-3 start ended when Freeman's desperation pass fell incomplete in the Atlanta end zone with no time left on the clock.

"The last drive, that's something we've done before this season," Falcons tight end Tony Gonzalez said. "I really think that's a positive for us to be able to come up with plays like that when we have to like that. ... I'm really happy with the way we responded."

It's getting to be a way of life. Ryan has also led late marches to beat Carolina, Washington, Oakland and Arizona this season and has put together 21 game-winning drives in the fourth quarter or overtime since entering the league in 2008 ? four of them against the division rival Bucs.

The Falcons won't have long to celebrate this one. They host the New Orleans Saints on Thursday night in a rematch of the only game they've lost.

"Ten and 1 is great, but I'll tell you what I've said since the beginning of the season: We're just jockeying for position," Gonzalez said. "We just want to put ourselves in the best position, playing the best football. Right around this time is when you want to start jelling as a team and take it on into the playoffs because that's the most important thing."

The win stopped the Bucs, who've won five or seven following a 1-3 start, from tightening the NFC South standings. Turner also scored a fourth-quarter TD that helped the Falcons overcome six turnovers to beat Arizona 23-19 last week.

"It was a hard-fought game by both teams, a very physical game," Schiano said. "But I do think missed opportunities were a big part of it. There were some chances both offensively and defensively, and in the kicking game."

NOTES: Martin scored on a pair of 1-yard run for the Bucs. ... After throwing seven interceptions in Atlanta's first nine games, Ryan has thrown six the past two weeks. ... Falcons CBs Asante Samuel (shoulder) and Dunta Robinson (head) left the game with injuries in the third quarter, but returned.

Paper Monsters tops Android Games of the Week

This week brings us an awesome lineup of titles from a great group of developers. Topping the list is the charming platformer Paper Monsters from publisher Crescent Moon Games, who are taking their first step into Android gaming. We've also got a zombie real time strategy game in which you play as the shambling undead, a sequel to Falling Fred, a new twin stick shooter from Triniti Interactive, and a Glu Mobile epic scale dragon battling game in the vein of Infinity Blade. Here are this week's top Android games!

Paper Monsters is the debut Android title form Crescent Moon Games. They've been wildly successful over on the iOS front, and they are one of my favorite publishers, always putting out unique, solid titles. Developed by Mobot Studios, this is a modern looking platformer with a very retro heart. Clearly inspired by Little Big Planet, though with much simpler gameplay, a similar arts and crafts art style makes up your world, with more papier-m?ch? and origami. This is an excellent little platformer, with lots of nods to classics games like Super Mario.

Here is a game I can get behind. It's one of the few games that lets you play on the side of the zombies, growing your horde and consuming all those pesky humans, instead of simply using zombies as easy targets for your gun. This is done with simple real time strategy gameplay from an isometric view. Between the two different game modes, there are a lot of tweaks you can make along with undead heroes and comics you can unlock. The visuals are simple and clean, and the controls can work surprisingly well. Mostly though, I just love the concept of this one, and I'm glad it's as well executed as it is.

Poor, poor Fred. The sadistic developers over at Dedalord seem to hate this gibbering ginger more than we could ever imagine. We've returned to the formula that initially introduced us to Fred over at Falling Fred, but this sequel cranks the violence and gore up to eleven. New traps, a shiny new art style that matches that of Running Fred, and plenty of new people to hurl down this bottomless pit of pain are but a few of the improvements and additions to be found in this sequel. These games are as hilarious as they are gruesome, and it's easy to recommend anything from Dedalord.

Here we have yet another port from Triniti Interactive. Call of Mini: Double Shot is the twin-stick shooter of this bizarre little world full of oddly proportioned people. If you haven't noticed the pattern, Triniti basically created their unique little art style, and then decided to apply it to as many genre's as possible. This shooter puts you and your friends against zombies and each other, with tons of weapons and avatars to unlock across 500 escalating stages. It's a very simple shooter that takes the "if it ain't broke, don't fix it" approach to development, and it's definitely worth a look.

Glu Mobile has re-entered the Infinity Blade style combat game arena, only instead of fighting gladiators in an actual arena, you'll be fighting tons and tons of terrifying dragons. The combat is based more on magic and spell casting then hacking, slashing, or bashing, and needless to say, this game feels a hundred times more epic than Blood & Glory ever did, with large scale, pulse pounding battles. It's much more colorful as well. But of course, this being Glu Mobile, they had to throw a monkey wrench into their own game, making it insanely difficult to progress without in-app purchases. Still, the game is pretty enjoyable.

Cutler sharp as Bears beat Vikings, 28-10

(AP) ? The Chicago Bears got Jay Cutler back from a concussion, only to lose three more stars to injuries.

Start with Devin Hester. Add Matt Forte and Charles Tillman to the list, and just for good measure, throw in two starting guards.

Consider this a painful win.

Cutler threw for 188 yards and a touchdown after missing a game, and the Bears broke it open early in a 28-10 victory over the Minnesota Vikings on Sunday.

The injuries, however, tempered some of the good feelings.

Tied with Green Bay for the NFC North lead and just a game ahead of Minnesota (6-5) coming in, the Bears (8-3) grabbed a 25-3 halftime lead thanks to Cutler's pinpoint passing. The defense held Adrian Peterson in check early on, although he finished with 108 yards rushing.

Chicago also came away with three more takeaways to increase its total from a league-leading 30 entering the game to 33.

The rather easy win came after back-to-back losses to Houston and San Francisco, but it also came with a heavy price.

The Bears lost Hester, a receiver and record-setting return specialist, early to a concussion. And that was just the start.

Forte, their top running back, hobbled to the tunnel midway through the third quarter with an ankle injury. Coach Lovie Smith said Tillman, their star cornerback, also hurt his ankle.

Besides those three, the Bears lost both guards in the third quarter to knee sprains, with Lance Louis and Chris Spencer going down. Louis' injury on a blindside hit by Jared Allen as Antoine Winfield returned an interception forced Chicago to go with Gabe Carimi, who lost the right tackle job to Jonathan Scott.

Spencer, meanwhile, was in the lineup after Chilo Rachal left the team.

If the Bears are going to develop any continuity on the line, well, don't expect it anytime soon.

"I don't think it's possible now," Cutler said. "With all the moving parts we have and Lance going down, you're not going to have that. We're going to have to roll with the guys we have and see what we have, lean on our defense as we have before, run the ball well. Be efficient through the air. See how far we go."

As for Cutler, he looked sharp after missing Monday's blowout loss at San Francisco.

Back after being knocked out of the Texans game on a helmet-to-helmet hit by Tim Dobbins, he got off to a scorching start and completed 23 of 31 passes with an interception to go with his TD.

"I felt good," Cutler said. "It was a matter of going through the motions, talking to the doctors. I had a good week of practice, a shorter week with the Monday game and Thanksgiving."

Brandon Marshall caught 12 passes for 92 yards and became the first Bears receiver since Marty Booker in 2002 to go over 1,000 yards. He now has 1,017 yards this season, his sixth straight with 1,000 or more.

"In the third quarter, I leaned over to Jay and said, 'That catch puts me at 1,000 yards for six seasons in a row.' And he looked at me and said, 'You're disgusting,'" Marshall, the Bears' big offseason acquisition, said, laughing.

He added he knew he was closing in because followers on Twitter had mentioned it.

On defense, Henry Melton set the tone by sacking Christian Ponder on the first play from scrimmage. Nick Roach set up the first touchdown by knocking the ball out of Peterson's hands. Chris Conte set another TD with a 35-yard interception return, and Julius Peppers blocked a field goal.

The league's leading rusher, Peterson tied Robert Smith's club record with a 100-yard performance for the fifth straight game even though he managed just 25 in the first half. He also lost two fumbles and had to catch a cab to the stadium and arrived about 90 minutes before kickoff, according to reports.

Ponder wasn't much help, going 22 of 43 with 159 yards and a touchdown along with an interception. His favorite target, Percy Harvin, sat out his second straight game with a sprained left ankle, and the Vikings lost for the third time in four games.

"We knew what we were getting into," Peterson said. "They wanted to make a statement. I thought it was more so what we did, giving the ball away, not making routine plays. Can't wait to see them again."

He won't have to wait long, with the Bears visiting Minnesota on Dec. 9.

Cutler completed 15 of 17 passes for 117 yards in the first half, and the Bears jumped out a big lead after a shaky start on offense.

Forte fumbled on Chicago's first play from scrimmage, leading to a 40-yard field goal by Blair Walsh ? all the scoring the Vikings did in the half.

The Bears broke it open late in the second half.

Bush scored from the 1 and holder Adam Podlesh ran in for a 2-point conversion that made it 18-3.

Ponder got picked off by Conte and he returned it 35 yards to the Minnesota 13. That led to a scoring strike from Cutler to a lunging Matt Spaeth on the next play.

NOTES: Vikings coach Leslie Frazier said he and Peterson were going to have a talk about punctuality after Sunday's delayed arrival. "There is something that Adrian and I need to talk about regarding getting to the stadium," he said. ... Allen thought his hit on Louis after Winfield's interception was a clean one. "I turned around, he was running to make a tackle and I threw myself into him to make a block. My condolences to him and his family. I never, ever, try and intentionally hurt anybody."

Guest column: Competition is 'fierce' for Housing Tax Credits ...

The Housing Tax Credit (Section 42 of the Internal Revenue Code) is the largest and most successful federal program for financing affordable rental housing in the nation.?Since the credit was created by the Tax Reform Act of 1986, it has helped to finance more than 2.4 million apartments.

Under the program, state agencies award Housing Tax Credits to developers, who sell the credits to private investors in exchange for funding for the construction and rehabilitation of affordable rental housing.

These funds allow developers to borrow less money and pass the savings on to tenants in the form of lower rents. Investors, in turn, receive a 10-year stream of tax credits based on the cost of constructing or rehabilitating the apartments, which, in general, cannot be rented to anyone whose income exceeds 60 percent of the area median income.

In Minnesota, developers submitted applications this summer for reservations out of the state?s 2013 Tax Credit Pool.?Each state is allocated credits based on population and a per capita volume amount of $2.20 in 2012 and $2.25 in 2013.

Minnesota has more than $11 million of Housing Tax Credits to award this year and competition is fierce. The 2013 First Round Awards were released Oct. 25, and more than 50 developments applied for tax credits.?But only 20 received an allocation.

Minnesota has a very strong group of affordable housing developers.?Here are examples of some of the projects currently under way in Minnesota:

  • The Dakota County Community Development Agency is working on another family housing project.? Its Family Townhome Program is designed for moderate-income families with children under age 18.? A typical tenant will be a family with a single mother, two children and an income of approximately $30,000.
  • Project for Pride in Living (PPL) is building a family housing project in St. Paul, known as Fort Road Flats, which will also provide housing and supportive services to homeless individuals.
  • Alliance Housing?s Gateway Lofts project is providing work force housing in North Minneapolis.
  • RS Eden is in the middle of construction of its 100-unit Emanuel Housing project for people who have been homeless, may be struggling with drug or alcohol addictions or have other challenges.
  • CommonBond Communities and Sand Companies have been granted the opportunity to create nearly 100 units of housing for homeless vets at Fort Snelling and in St Cloud.
  • Twin Cities Housing Development Corp. just completed the substantial rehabilitation of Northgate Woods, a 75-unit property for seniors and families in Blaine.

Many factors are currently working in favor of producing the affordable apartments. Demand is high for the affordable apartments. Interest rates are at historically low rates, enabling developers to obtain favorable mortgage terms.

But demand for the credits remains high. Many banks, like U.S. Bank and Wells Fargo, are buying Housing Tax Credits for economic returns as well as Community Reinvestment Act (CRA) requirements, which push banks to reinvest in the neighborhoods in which they do business.

Other investors include well-known companies such as Verizon & Google. Google recently invested in George Sherman?s recapitalization of the 1,000-unit Riverside Plaza in Minneapolis.

In rural Minnesota, developers are anxiously awaiting funding of the Minnesota Equity Fund, which was formed by the Greater Minnesota Housing Fund to invest in rural Minnesota projects.

Some Housing Tax Credit deals are paired with Historic Tax Credits. Certain older, historic structures qualify for the Historic Tax Credit if a qualified rehabilitation of the structure is undertaken.

The Minnesota Historic Tax Credit enacted in 2010 piggy-backs on the federal Historic Tax Credit, providing another source of financing for qualified projects. Aeon?s Renaissance Box project in St. Paul, along with Riverside Plaza in Minneapolis, are projects using the Housing Tax Credit along with federal and state Historic Tax Credits.

Still, using Historic Tax Credits may complicate a deal. Recent tax decisions have thrown a monkey wrench in the structuring of these deals. The Historic Boardwalk Hall case, which involved the restoration of the Atlantic City, N.J., convention center, recently shut down closings of federal Historic Tax Credit transactions. And, a Commonwealth of Virginia case has caused uncertainty in state Historic Tax Credit deals.

As a result, industry experts are being very careful in structuring new historic credit deals.

The success of the Housing Tax Credit program has been well-documented, however. In 1989 and in 1997, the U.S. Government Accountability Office (GAO) reviewed the program and concluded it was serving its intended purpose ? to provide affordable housing to needy individuals.

A 2007 Harvard study found ?the Housing Credit has sound underpinnings and a track record of success in delivering rental housing assistance.?

The study cited ?its many appealing features? including ?its allocation primarily by state, and some local, agencies (making it responsive to local market conditions); the leveraging of private capital with strong interests in managing properties (so tax credits are not recaptured); and the placement of liability on owners rather than the federal government in the event of failure.?

This year?s election was very important to our nation.?Many important issues will need to be addressed.? Among them are our country?s unsustainable level of debt, budget deficits, tax reform, the housing market and the economy.?The Housing Tax Credit may find itself squarely in the middle of these tough issues.

I hope the Housing Tax Credit survives to continue the good work it has been doing for the last 25 years.

Free flu shots in Santa Ana - The Orange County Register

Flu season has officially arrived in Orange County with the first confirmed case, the county's Health Care Agency announced this week.

Public health officials are urging vaccination for everyone 6 months and older, particularly infants and young children, pregnant women, older adults and those with chronic medical conditions.

FLU SHOT: Seasonal flu shot clinics offering free shots to people in high-risk groups are under way in Orange County.

The illness is spread by mosquito bites and can cause serious illness in a few people. Roughly 80 percent of those infected will show no symptoms.

Mild symptoms do not generally require medical treatment and include fever, headache, nausea and sometimes a rash.

Last year, there were 10 infections. Local cases peaked in 2008 with 79 infections.

FDA OKs NEW FORM

OF FLU VACCINE

The Food and Drug Administration says it has approved the first seasonal flu vaccine made using animal cell technology, rather than the egg method that has been standard for the past half century.

The FDA approved Novartis' Flucelvax to prevent flu in people 18 and older.

The new method has been promoted by U.S. health officials because it is faster than egg-based production and could speed up manufacturing in the event of a pandemic.

In the older method, virus samples are injected into specialized chicken eggs and incubated. The egg fluids are later harvested, concentrated and purified into the vaccine.

With cell technology, small amounts of virus are put in fermenting tanks with nutrients and cells derived from mammals. The virus is then inactivated, purified and put into vaccine vials.

CHOC OFFERS DONATION OPTION

Children's Hospital of Orange County is part of a so-called crowdfunded gift catalog where people can purchase a toy or wheelchair for the hospital.

The nonprofit GiveMiracles.org allows donors to select a gift (a pediatric wheelchair costs $970, while a box of 360 preemie diapers costs $170) and then receive updates on how their gift is being used.

The website also allows donors to raise small donations from friends and family via Facebook, Twitter and LinkedIn.

CHOC's goal is to raise $40,000.

HOAG REMODELS HEART INSTITUTE

Hoag Hospital in Newport Beach has opened its remodeled heart and vascular institute, which includes a new lobby and an operating room that allows a diseased aortic heart valve to be replaced without open-heart surgery.

The 34,650-square-foot facility consolidates cardiac services ranging from operating rooms to catheterization labs.

Last year, Newport Beach couple Bob and Marjie Bennett donated $2 million for the hybrid operating room with imaging technology that gives doctors a 3D view inside the body.

The project will be complete in January with the addition of meeting space and a healing garden.

KOMEN HONORS VOLUNTEERS

Last week, Orange County's Susan G. Komen for the Cure affiliate honored volunteers for donating 37,130 hours of support during the past year.

Volunteers helped with everything from the September Race for the Cure to working in the office.

"For more than two decades, this determined affiliate has made a tremendous impact in the fight against breast cancer and could not have done it without the steadfast support and generosity of spirit from the volunteers who help activate our mission to find a cure," Executive Director Lisa Wolter said.

Among those honored: Nina Rattner of Los Alamitos, who has volunteered continuously since the affiliate started more than 20 years ago. She has helped to chair the survivor tribute ceremony at each Race for the Cure since 2004.

In time for the holidays, the Susan Samueli Center for Integrative Medicine at UC Irvine is offering stress reduction courses.

A backdrop of trees and hillsides smear together from the speed of the highway. In the rear seat, the kids finger scroll on a phone or pluck away with their thumbs on a hand-held game. The silence of the road, the droll hum of rubber speeding on asphalt, offers a welcome respite from what?s behind you. Everyone needs a break.

Ahead through the windshield, somewhere up there, your family is hurrying to prepare for you, running errands, searching for the right pot and double checking for spots on the good silverware. Someone is fumbling with the legs of the kids? table. Next year there?ll be a new one. The thoughts make you smile as the underpasses pass overhead and the whole scene gets closer with every green highway sign.

Thanksgiving, thankfully, is the good holiday, the one that sells the least amount of home decor and isn?t measured by the depth of the wrapping paper pile. We can?t let discounts and two-for-ones take over the one holiday that?s still, really, about family, the one that?s centered on togetherness.

Financial markets are once again having to focus on a number of events around the globe that could further unsettle investors already worried about the fiscal cliff in the U.S.

Stocks in Europe initially fell following Moody's downgrade of France's debt to one notch below the top AAA rating, but recovered slightly ahead of a decision by European finance ministers on whether to release more bailout funds to Greece.

Meanwhile, in the Middle East, Israeli air strikes and Palestinian rocket fire continued in and around Gaza, raising pressure on the international community to defuse the week-long conflict. Egypt's president Mohamed Morsi, who's been trying to broker a ceasefire, announced earlier that the Israel offensive would end today, according to the state news agency. (Subsequent reports continued to suggest the combat might wane, but a formal stop to the fighting hasn't yet been confirmed.) Elsewhere, United Nations Secretary General Ban Ki-moon has been calling for an immediate ceasefire, and both he and U.S. Secretary of State Hillary Clinton were separately on their way to the region. Crude oil prices were up more than $1 a barrel after gaining $2 Monday.

Jim Rickards, partner at JAC Capital and author of "Currency Wars," is much more optimistic about the situation in Europe than the Mideast. He sees three main reasons to be hopeful about Europe:

  • China is eager to invest in Europe and diversify its foreign exchange holdings.
  • Young people in Europe are willing to work for less than their older counterparts.
  • Germany, an export powerhouse for more than 40 years, has finally accepted the necessity of slightly higher inflation.

"The U.S., Europe and China all have to go through major structural adjustments," Rickards says. "The difference is Europe is stepping up to the plate and doing it. The U.S. and China are still in denial."

Rickards isn't concerned with Moody's downgrade of French debt, despite the fact that it concerns one of Europe's stronger nations. "Ratings agencies don't know anything about sovereign credit," he says. "They're using corporate finance metrics and completely ignore fact that these are sovereign countries with armies, weapons ... that you can't put into a financial model."

At the same time, Rickards seems as pessimistic about the Mideast as he is optimistic about Europe. He says the Israeli-Gaza conflict could be the beginning of a much bigger conflict between Israel and Iran, which is he calls "the main event." That may be one reason oil prices have risen a few dollars in the past few days, but haven't surged, he says.

"The countdown has begun," says Rickards. He believes Israel's tensions with Iran could escalate into war as early as March unless Iran "verifiably" gives up its uranium enrichment program.
