The Shutdown Continues, the Supreme Court Gears Up, and Malcolm Gladwell Defends Himself

How Democrats Got a Spine: The Republican Party taught them how to be uncompromising,” by David Weigel. “If you want to bear the responsibility for the crisis you’ve created, then you bear it, and we’re gonna stand firm.” That’s the message Democrats have delivered to the GOP in the midst of the government shutdown and debt ceiling standoff. “The intransigence of Democrats, from Obama on down to red-state senators, has surprised the GOP,” writes Weigel. He says Democrats learned how to be uncompromising by watching the Republican Party.  














“Why I Stopped Writing Recommendation Letters for Teach for America: And why my colleagues should do the same,”by Catherine Michna. Every year, Teach for America “installs thousands of unprepared 22-year-olds, the majority of whom are from economically and culturally privileged backgrounds, into disadvantaged public schools,” Michna writes. The result? “The nation’s youngest and most needy children are harmed by the never-ending cycle of under-trained, uncertified, first- and second-year teachers that now populates disadvantaged schools, and by the data-obsessed approach to education that is enabled by these inexperienced teachers,” she says.










Err Engine Down: What really went wrong with healthcare.gov?” by David Auerbach. “Bugs rarely manifest in obvious forms, often cascading and metamorphizing into seemingly different issues entirely, and one visible bug usually masks others,” writes Auerbach. So it’s difficult if not impossible at this stage to point to “the problem” with healthcare.gov, the government’s online Obamacare interface, which has been plagued with glitches since its Oct. 1 rollout. In all likelihood, “Healthcare.gov’s failures are not uncommon, they’re just exceptionally high-profile,” writes Auerbach.

The Supreme Court opened its new term this week, hearing oral arguments in McCutcheon v. Federal Election Commission. “At issue in McCutcheon are the ‘aggregate’ contribution caps that limit the total amount any one person can give candidates, parties, and political committees during a two-year election cycle,” writes Lithwick, whose article recounts the court’s wrestling over the most important campaign finance case since Citizens United










Wait, I Thought We Were Fighting Over Obamacare? Some Republicans think the budget battle is about blocking Obamacare. Others have moved on. What is the GOP fighting for?” by John Dickerson. At some point in the government shutdown and debt ceiling standoff, portions of the GOP made a strategic shift from a fight it was losing on Obamacare defunding. Dickerson writes that the new tack—shifting the focus toward government spending—has better odds than the push to defund the president’s signature legislative achievement ever did. “In little more than a week,” Dickerson writes, “the president's health care plan has gone from the single reason for the budget showdown to an implied one.”










The Coming of the Kagan Court: Why Elena Kagan is the most influential liberal justice,” Adam Winkler. Justice Elena Kagan began her fourth term when the Supreme Court reopened last week after its summer recess. But already Kagan is “laying the groundwork to be an influential player on the court for decades to come,” Winkler writes. Winkler reasons that Kagan’s temperament and judicial style make her less an “Aggressive Progressive” than “a politically astute relationship-builder” in the mold of Earl Warren.










“Who Are These Guys? Eight votes that explain who House Republicans really are,” by David Weigel. It’s sometimes hard to distinguish one middle-aged white male Republican House member from another. But since these 232 elected GOP officials represent much of the obstructionism in Congress, Weigel steps in to help readers make sense of the House Republican composition by breaking it down to several camps: the “Hell No” caucus, the Heritage Action caucus, and the Invisible Caucus.

But Chabris explores whether Gladwell is accurately conveying the science that undergirds his narratives. “Not whether he is making little mistakes or leaving out details that would bore the nonspecialist,” Chabris writes, “but whether he is getting the big ideas right.” Chabris’ critique of Gladwell’s David and Goliath sets the stage for current and forthcoming articles to appear on the Slate Book Review.

Mursi faces trial as U.S. reviews aid to Egypt

CAIRO (Reuters) - Egypt's ousted President Mohamed Mursi will stand trial on November 4 on charges of inciting the killing of protesters, a prospect sure to raise concern in Washington, already considering cutting aid as a way to urge Cairo to restore democracy.


Mursi has been held in a secret location since his overthrow on July 3. If he is brought before the court, it would be the Islamist leader's first public appearance since then.


The trial could further inflame tensions between the Muslim Brotherhood and the army-backed government and deepen the political instability that has decimated tourism and investment in the most populous Arab state.


The upheaval worries Cairo's Western allies, who were hoping the uprising that ended Hosni Mubarak's 30-year rule would turn the region's biggest country into a democratic success story.


The United States and European Union had wanted an inclusive political process in Egypt, which has a peace treaty with Israel and controls the Suez Canal waterway between Europe and Asia.


Mursi, Egypt's first freely elected president, and other Brotherhood leaders accuse the army of staging a coup that reversed the gains of the 2011 revolt against Mubarak.


The army says it was carrying out the people's will and has presented a plan it says will lead to free and fair elections.


Judge Nabil Saleeb said Mursi and other Brotherhood members had been charged with "inciting the killing and torture of protesters in front of the Etihadeya (presidential) palace".


U.S. REVIEWS AID


The charges relate to the deaths of about a dozen people in clashes outside the presidential palace in December after Mursi enraged protesters with a decree expanding his powers.


Egypt has been in turmoil since the army removed Mursi following mass protests against his rule and then launched a tough crackdown against his Brotherhood, killing hundreds at protest camps and marches and arresting about 2,000.


Mursi supporters and security forces clashed again on Sunday, one of the bloodiest days since the military took power, with state media reporting 57 people dead and 391 wounded.


The United States is leaning toward withholding most military aid to Egypt except to promote counter-terrorism, security in the Sinai Peninsula that borders Israel, and other such priorities, a U.S. official said on Tuesday.


The official said President Barack Obama had not made a final decision on the issue, which has vexed U.S. officials as they balance a desire to be seen promoting democracy and rights with a need to keep up some cooperation with Egypt's military.


After Mursi's ouster, the Obama administration said it would suspend about $585 million in military assistance to Egypt pending a wider policy review.


The U.S. official, who spoke on condition of anonymity, said the Obama administration was now inclined to continue withholding most of that, with the exceptions described above.


The United States is also considering continuing some economic aid to Egypt, but chiefly funds that go to non-governmental groups rather than to the government itself, the official said.


Cairo said it had received no official word on the issue.


"The relationship between Egypt and the United States is one of partnership, and not one of donor and recipient," said Foreign Ministry spokesman Badr Abdelatty.


Egypt has for decades been among the largest recipients of U.S. military and economic aid because of its 1979 peace treaty with U.S. ally Israel, which agreed to withdraw from the Sinai Peninsula it seized from Egypt in 1967 as a result of the pact.


Washington has long provided Egypt with about $1.55 billion in annual aid, including $1.3 billion in military assistance.


Aside from the political crisis, Egypt's interim government faces an Islamist insurgency in the Sinai, near Israel and the Gaza Strip, which is run by the Palestinian militant group Hamas, an offshoot of the Muslim Brotherhood.


Four Egyptian soldiers were wounded on Wednesday when militants threw an explosive device at their car in central Sinai, security sources said. An army camp in Rafah, northern Sinai, was attacked by rocket-propelled grenades but there was no immediate report of casualties.


Al Qaeda-linked Islamist militants in the Sinai have stepped up attacks on soldiers and police since the army toppled Mursi and have on occasion extended their campaign into major cities. A Sinai-based group claimed responsibility for a failed suicide bombing targeting the interior minister in Cairo in September.


Security sources said Mursi was expected to be tried at a Cairo police institute near Tora, Egypt's most notorious prison, which held Mubarak until he was moved to house arrest in August.

Swell Radio (for iPhone)


The recently released Swell Radio is unofficially billed as "Pandora for radio," and after using it for several hours, I understand why. The free iPhone?app lets users stream news, comedy, sports, and business content to their Apple iPhones?content that adapts to your listening habits to create a customized experience. Fans of news, podcasts, and talk radio should consider giving Swell Radio a download.

Tuning In
Unlike Stitcher Radio (an app that provides a similar service), Swell Radio doesn't require you to create an account?you can jump right in. Swell Radio sports a simple but elegant interface that's remarkably clutter-free. Swell Radio utilizes "audio cards," rectangular panels that contain important information such as the show/station/podcast's name, runtime, and the broadcast date. There are also two icons that let you rewind a track in 10-second intervals or fast-forward in 30-second intervals. Tapping the small information icon flips the audio card where you can find a show synopsis and a link to the show's homepage.

NPR, Comedy Central Stand Up, and BBC Documentaries are just a handful of the many stations available. The audio streamed to my Sony MDR headphones was crisp and clear; in fact, Swell Radio sounded better than many terrestrial radio stations, as there were no pops or hisses. If you dig into the settings, you can find an option to for "high-quality streaming" that's designed to improve audio (when a show offers it).

Listening In
Brining a finger to the Swell logo opens a genre listing that includes technology, business, arts, TV& film, culture, music, comedy, and other categories. Selecting music took me from the informative Freakonomics show to a program that featured several indie artists. Switching categories causes Swell Radio to play a handful of the new genre tracks, before reverting to the normal mixed-content stream. Unlike Stitcher Radio you cannot ban or favorite shows.

Note: Swell Radio doesn't let you continuously listen to one topic or genre, as some other music streaming apps do. For example, if I fired up Slacker Radio's '80s station, I'd be fed nothing but tunes from the decade of decadence. Swell Radio, on the other hand, streams a variety of topics that are constantly tweaked based on several criteria. Swell Radio also doesn't offer live radio, which is SiriusXM Radio's bread and butter. Instead, it has timely recorded programming; I listed to Grantland's Jalen Rose Report podcast just hours just a few hours after it went live.

Like Slacker Radio and many other audio streaming services, Swell Radio constantly tweaks the listening experience based on your actions?it's not a traditional podcast. The app knows what you like based on how long you listened to a particular genre, when you skipped a program, the "wisdom of the Swell community," data from your Twitter stream (if you follow lots of sports teams, Swell Radio serves up more sports content), time of day, and the time since last fired up the app. You can also share content via Facebook, Twitter, and email. Swiping up on an audio card bookmarks a track, so that you can return to it at a later time.

Radio Days
There is a sea of iPhone apps designed to stream music, but very few have a laser-beam focus on news and talk. Swell Radio is impressive, but not strictly because of the novel idea; it's an app that iPhone users should download if they dig non-music radio and podcasts. Should developer Concept.io allow users to continuously stream their genres of choice (a feature that Stitcher Radio offers), this already impressive app will be that much better.

(AP) ? It was supposed to be a thrilling ride down a ski slope inside a giant inflatable ball that is to be one of the symbols of next year's Winter Olympics; it ended in tragedy for the two Russian men inside.

The transparent plastic ball ? known as a zorb ? veered off course and sailed over a rock ledge in the rugged Caucasus Mountains of southern Russia. The ball picked up speed as it flew down the steep slope, rolling and bouncing. One man was killed and the other badly injured.

The man who died, 27-year-old Denis Burakov, was with friends at the Dombai ski resort, where they frequently went snowboarding, on Jan. 3 when he decided to take a ride in a zorb being operated next to a beginners' slope. His friend Vladimir Shcherbakov joined him.

An eight-minute video taken on Burakov's phone by one of his friends shows the two men being fitted into harnesses inside the zorb, which consists of two polyurethane balls with a layer of air between them. The zorb is then released to roll down the hill, the two men spinning inside.

But the zorb bounces off of the intended path, and a man waiting for it at the bottom of the hill tries in vain to catch the ball before it pops over a rocky ledge and disappears down a gorge below Mount Mussa-Achitara.

The person filming the video is heard swearing and asking "What's down there?" The answer from someone off camera: "It's a catastrophe down there."

The Emergencies Ministry said both men were ejected from the zorb as it tumbled and they landed on the snow about 10 meters (30 feet) apart after having rolled about 1.5 kilometers (a mile). Still conscious and able to stand, they were rescued by two skiers, who then pulled both men up to the top of the hill. Burakov suffered serious spinal injuries and died on the way to the hospital. Shcherbakov suffered a concussion and other injuries and remains hospitalized.

The accident prompted the emergencies minister to demand on Wednesday that Russia address its lax enforcement of safety rules for winter sports, citing a series of accidents over the January holidays. Vladimir Puchkov said during a televised meeting with officials in charge of rescue services across the country that they should take extra measures to ensure safety, in particular at Russia's ski slopes.

Sergei Loginov, deputy director of Z-orb.ru, the largest supplier of zorbs in Russia, said the zorbing run that killed Burakov was in violation of all safety rules. Zorbing requires a groomed gentle slope with fences on both sides of the track and a secure spot at the bottom where the ball can be safely brought to rest, he said, but none of this was present at Dombai.

"It's not even irresponsibility. It's an experiment on life," Loginov said. "It's all or nothing. They either survive or they don't."

The sport of zorbing originated in the 1990s in New Zealand and is now done around the world, most often on grassy slopes. Loginov said there are several zorbing spots on the outskirts of Moscow and dozens more around the country.

Zorbs have been adopted as a symbol of the 2014 Winter Olympics, which Russia is holding in Sochi.

"The transparency of zorbs also reflect the open, accessible and inclusive society that Sochi 2014 Games is helping to build," Dmitry Chernyshenko, head of the organizing committee, said in 2010.

Sochi's modern ski resorts also are in the Caucasus Mountains. Dombai and other less-developed resorts are located to the east in the North Caucasus region, a patchwork of mainly Muslim republics suffering from poverty and unrest stemming from an Islamic insurgency.

"Until 2006, hundreds of people died every year at the North Caucasus ski resorts," said Kantemir Davydov, an Emergencies Ministry spokesman in southern Russia. "That number has fallen sharply, but still on average 20 to 30 tourists die every year. The causes of the deaths are various, but the root is the same: There is no clear system assuring tourism safety."

Eager for any business that brings in badly needed tourist revenue, local officials are reluctant to enforce safety requirements, Davydov said.

Federal investigators said they were inspecting the Dombai resort and attempting to determine who was responsible for the fatal zorb ride.

Russian state television suggested that one reason winter sports in Russia so often take lives is that people too often ignore basic safety rules. Its report showed families sledding on a slope near Moscow that was clearly marked "no sledding" and said six people had been hospitalized Tuesday with injuries, including concussions and broken bones.

In Italy, a snowmobile driven by a Russian citizen crashed into a ravine during a nighttime outing on a steep ski slope last week, killing six Russians being pulled behind the vehicle on a sled. Italian police arrested the driver on Wednesday.
